Kenner is also known for his 1992 book Totally Out of Control in which his popular flourish Sybil was first published.[1][2][3][4][5][6] LitigationKenner was heavily involved in a legal dispute concerning an audience member of David Copperfield's show in Las Vegas, where Kenner works as executive producer.[7] Gavin Cox, a British tourist, participated in Thirteen, a popular illusion that was an integral part of the show. Cox claimed that he fell during the performance due to poorly constructed passageways, suffering permanent brain damage. Throughout the trial, Kenner was questioned regarding his role as producer within the performance, as well as certain technical aspects of the illusion. Due to the fact that Kenner was credited as a lead illusion designer, he was asked to demonstrate and explain how the illusion was performed under oath. After weeks of questioning, Kenner's company DCDI Productions was deemed ultimately negligent but not liable for the damages suffered. The case sparked a considerable amount of controversy surrounding trade secrets and legal ethics; the court's decision to have Kenner publicly explain how the illusion is performed was criticized by magicians.
