Federation of Regulatory Counsel, Inc.

The Federation of Regulatory Counsel, Inc. (FORC) is a nation-wide professional association of attorneys specialized in the arena of insurance regulatory law. FORC was formed for the purpose of raising the standard of excellence in the practice of regulatory law and for promoting the expertise and abilities of its members to their clients, the insurance industry, and other lawyers requiring their specialized skills. FORC is an Internal Revenue Code Section 501(c)(6) non-profit organization.

FORC Associate & Regulatory Counsel Members are:
  • Fully vetted by the FORC Admissions Committee with an intensive application processes including interviews with candidates to ensure all membership criteria are met or exceeded.
  • Licensed qualified attorneys with a minimum of five, but typically decades, of insurance regulatory law experience.
  • A member in good standing in at least one state bar association and continue to certify this member requirement annually.
  • Focused on insurance regulatory law and bill more than fifty percent of their time to insurance regulatory matters.
  • Recommended in writing by three insurance industry executives from unrelated companies who have attested to their skill and competency.
  • Recommended by three additional FORC members, or three additional attorneys, which are acquainted with and/or have had professional dealings with the member.
  • Capable of performing related services in at least two of the following categories of insurance law practice:
    • Insurance Business Transactions: Reinsurance, acquisitions, company formations, mergers, redomestication, corporate governance, purchase and sale of blocks of business, etc.
    • Legislation: Drafting, amending, proposing, monitoring and opposing bills, and resolutions relating to insurance laws and regulations
    • Litigation: Disputes involving insurance business transactions or regulatory enforcement actions, but not insurance claims disputes.
    • Regulation: Liaison with state insurance regulatory officials regarding insurance company matters, producer matters, policy filings, transaction filings, admissions, rulemaking, prehearing investigations, etc.
  • Knowledgeable in the industry which is confirmed by authorship in the FORC Journal of Insurance Law and Regulation[1] and other industry publications.
  • Connected to other FORC insurance regulatory attorneys throughout the country to use as additional resources as needed.

Publications

FORC Journal - The FORC Journal of Insurance Law and Regulation (the Journal) is a journal published by the Federation of Regulatory Counsel (FORC). The Journal includes articles of interest to insurance industry participants and law practitioners with a focus on impactful and emerging regulatory issues and trends. The Journal is central to our mission to demonstrate members’ excellence in, and dedication to, the practice of regulatory law. FORC collects from its membership original manuscripts that showcase their advanced skill-set and highlight certain areas of a particular member’s expertise. The Journal is transmitted electronically to FORC members and other persons who have indicated interest in receiving the Journal. It is also posted on the FORC website and made available in hard copy at various public events such as NAIC meetings[2]. Over 20 years of Journal articles are archived on the FORC.org website which includes a search tool for quick access to a particular topic or author. Each article includes full contact details of the author.

FORC Alerts - FORC combines state and federal news from FORC counsel members to produce a synopsis of the latest developments in insurance regulatory law. Alerts are sent via email to members and to those who have signed up to receive FORC communications. Alerts are typically distributed bi-monthly, or more frequently as needed to share current developments. Over 10 years of Alerts are archived on the FORC.org website which includes an advanced search option.

History

The founders of the FORC, Nicholas M. Monaco, Hugh Alexander and Allan Wade "Dick" Horne, met in Kansas City in 1988 at the executive offices of Employers Reinsurance Corporation. The founders met to form an organization of lawyers which would include former insurance regulators and practicing insurance regulatory attorneys who possessed the expertise needed to assist and advise insurers and others licensed to conduct the business of insurance before the various state departments of insurance where each FORC member resides. The goal was to have FORC members in each of the various states qualified to handle issues related to allegations of non-compliance with the insurance laws and regulations, and qualified to handle insurance regulatory filing requirements, compliance and financial matters. A corporation was formed to be known as the Federation of Regulatory Counsel (“FORC”), pronounced “Force,” with the understanding membership would include attorneys licensed to practice law in at least one state to assist home state, foreign and alien licensed insurers, and other licensed entities, insurance agents, and brokers. The principal purpose of the FORC was to identify attorneys specially qualified in insurance regulatory law to assist insurers and other insurance licensees who seek to assure they remain in compliance with the laws and regulations enacted for the protection of the insurers and the insurance buying public. Those specially qualified attorneys would become eligible to join the FORC to participate in fulfilling the Mission of the FORC, which states the FORC is, “a professional association of insurance regulatory lawyers formed for the purpose of (1) raising the standard of excellence in the practice of regulatory law, and (2) promoting the expertise and abilities of its members to their clients, the insurance industry, and other lawyers requiring their specialized skills.”
