Madeleine de Cock Buning (b. 1966) is a Dutch public administrator, lawyer, and regulatory officer. She is the chair of the Board of Commissioners of the Dutch Media Authority (in Dutch: Commissariaat voor de Media), which is charged with protecting the independence, diversity, and accessibility of Dutch media outlets. She is also a Lecturer in Copyright, Communications and Media Law at Utrecht University.

Professor de Cock Buning has been concerned throughout her professional career with the question of how technological and social innovations can be embedded into regulations and regulatory procedures in a balanced and viable manner.

Education

Madeleine de Cock Buning earned her undergraduate degree in Information Technology & Law and Dutch Law from the University of Amsterdam. She obtained her Ph.D. in 1998, writing her thesis on ‘Copyright Law and Information Technology: on the Limited Shelf-Life of Technology-Specific Regulations’ under the auspices of the University of Amsterdam’s Institute for Information Law.

In 2001 and 2002, she held an appointment as a visiting scholar at Columbia University in New York, on the invitation of Professor Eben Moglen and Professor Jane Ginsberg.

Professional career

Madeleine de Cock Buning joined the Board of Commissioners of the Dutch Media Authority in 2008 and has served as chair of this board since 2013.

In January 2018, she was appointed by European Commissioner Mariya Gabriel as chair of the [https://ec.europa.eu/digital-single-market/en/news/experts-appointed-high-level-group-fake-news-and-online-disinformation High-Level Group on Fake News and online disinformation], where she is responsible for analyzing the fake news phenomenon in Europe and finding potential solutions to this issue. The group is comprised of 40 members from the various EU Member States, with backgrounds in journalism, academia and civil society. Professor de Cock Buning submitted her report to the European Commissioner on 12 March 2018.

Since 2007, Professor de Cock Buning has been a [https://www.uu.nl/medewerkers/MdeCockBuning/ lecturer in Copyright, Communications, and Media Law] in Utrecht University’s [https://www.uu.nl/organisatie/departement-rechtsgeleerdheid Department of Law, Economics, and Governance]. Her responsibilities in this role include innovation, technology, and law (e.g. robotization and artificial intelligence). She is also appointed as a lecturer at the [https://stg.eui.eu/ School of Transnational Governance] of the European University Institute (STG/EUI) in Florence. She also serves as chair of the Centre for Intellectual Property Law (CIER).

From 2016 to 2018, Professor de Cock Buning chaired the [https://ec.europa.eu/digital-single-market/en/avmsd-audiovisual-regulators European Regulators Group for Audiovisual Media Services], a group of national independent regulatory bodies within the EU. One of her key priorities during her tenure as chair was the protection of minors from harmful content on television, online platforms and websites. She also advocated the independence of media regulators across Europe in their role as buffers between politicians and the media. Independent regulators are essential in order to be able to guarantee the independence of the media as one of the essential elements of the democratic rule of law. The revised [https://ec.europa.eu/digital-single-market/en/policies/audiovisual-media-services European Audiovisual Media Services Directive] (AVMS Directive) provides for the long-term protection of minors online and guarantees the independence of media regulators.

From 1998 to 2009, Professor de Cock Buning worked as an attorney at the Amsterdam law firm De Brauw Blackstone Westbroek, where she was responsible for providing advice to, and litigating on behalf of, companies (including listed companies) engaged in information technology, intellectual property, and advertising law.
