Practice areas

HKM represents workers in individual and class actions in all aspects of employment law.[1]

History

HKM was co-founded in 2009 by partners Donald W. Heyrich, Daniel Kalish, and Patrick Leo McGuigan. It is headquartered in Seattle, WA. The firm has since grown to 22 attorneys and operates out of offices in 9 states.[2]

Shemia Fagan, a Democratic member of the Oregon Senate,[3] is an attorney at HKM's Portland office.[4]

Notable cases

  • HKM has filed several class action suits alleging violations of the Telephone Consumer Protection Act of 1991 (TCPA).[5][6][5] It was alleged in a 2012 case that Papa John's Pizza had spammed hundreds of thousands of their customer's cellphones with promotional texts.[6] Papa Johns negotiated a $16.5 million settlement with each claimant receiving up to $50 and one free pizza.[7] A similar case involving the ride-hailing service Lyft, filed in 2014, was settled for $4 million and is open for claims from Washington state residents as of March 2019.[8] In addition to claims from consumers, the plaintiffs have requested that Lyft pay $1m in fees billed by HKM and a second law firm.[9]
  • HKM represented former employees of indoor soccer team Seattle Impact in their civil lawsuit against owner and player Dion Earl alleging unfair dismissal and sexual assault. Earl was ordered to pay $1 million in damages and costs in a default judgment issued in 2017.[10]

Pro bono work

In 2018, HKM offered free legal advice to federal and state workers who refused to enforce the Trump adminstration's policy of separating immigrant families.[11][12]

HKM has also offered pro bono legal advice to federal employees furloughed during the 2018–19 United States federal government shutdown.[13]
