The Russian Federation joined the Council of Europe on February 28, 1996, and on March 30, 1998, it ratified the European Convention for the Protection of Human Rights and Fundamental Freedoms. Thus, Russia reaffirmed its commitment to the ideals and principles of humanism and democracy, as well as its readiness to correct a number of legislative acts that contradict the provisions of the Convention. By joining the Council of Europe, Russia assured the organization that it is ready to bring its legislation and political system in line with European norms.

Since joining the Council of Europe, Russia has been criticized by its member states for violating human rights, the war in Chechnya, curtailing democratic freedoms and oppressing the media. The second Chechen war could lead to the expulsion of Russia from the Council of Europe, but the sanctions were limited only to deprivation of the word of its delegation in the Parliamentary Assembly of the Council of Europe (PACE) in 2000.

PACE insists on Russia's abolition of the death penalty as soon as possible, indicating that it is the only member of this organization who has not fulfilled this obligation. May 16, 1996, Russian President Boris Yeltsin signed a decree on the phased reduction of the use of the death penalty. An actual moratorium on the death penalty was established, but the Criminal Code still has this type of punishment, although since 1996 there has not been a single sentence of capital punishment.
