Thomas Marcelle is an American judge from New York currently serving on the Cohoes City Court and is a nominee to be a United States District Judge of the United States District Court for the Northern District of New York.

Education

Marcelle received his Bachelor of Arts from Bowdoin College and his Juris Doctor, magna cum laude, from Cornell Law School, where he served on the Cornell Law Review.[1]

Legal career

Prior to joining the court, he served as Chief Counsel to the Albany County Sheriff's Office and Albany County Attorney, where he oversaw the litigation of civil matters and prosecution of criminal matters. He also enjoyed a long, prestigious career in private practice; his practice focused on constitutional litigation, with a focus on election and constitutional issues. He also served as a Trial Attorney in the Civil Rights Division of the United States Department of Justice, responsible for enforcing the Civil Rights of Institutionalized Persons Act.[1]

State court service

He is currently a judge on the Cohoes City Court.[1]

Nomination to district court

On October 10, 2018 President Trump announced his intent to nominate Marcelle to serve as a United States District Judge for the United States District Court for the Northern District of New York. On November 13, 2018, his nomination was sent to the Senate. President Trump nominated Marcelle to the seat on the United States District Court for the Northern District of New York vacated by Judge Gary L. Sharpe, who took senior status on January 1, 2016.[2]

On January 3, 2019, his nomination was returned to the President under Rule XXXI, Paragraph 6 of the United States Senate. On January 23, 2019, President Trump announced his intent to renominate Marcelle for a federal judgeship.[3] His nomination was sent to the Senate later that day.[4] His nomination is currently pending before the Senate Judiciary Committee.
