The Constitutional Court of the Republic of Albania ({{lang-sq|Gjykata Kushtetuese e Republikës së Shqipërisë}}) is the final authority for the interpretation of the Constitution (Kushtetuta) and the compliance of laws in accordance with the constitution.[2] As of article 168, the ourt guarantees respect for the Constitution and makes final interpretations of it.

The Constitutional Court is composed of 9 members, which are appointed by the President (Presidenti) with the consent of the Parliament (Kuvendi).

Responsibilities

As of the Articles 168-177 of the Albanian Constitution, Constitutional Court decides on:

  • compatibility of the law with the Constitution or with international agreements as provided in Article 126
  • compatibility of international agreements with the Constitution, prior to their ratification
  • compatibility of normative acts of the central and local organs with the Constitution and international agreements
  • conflicts of competencies between powers, as well as between central government and local government
  • constitutionality of the parties and other political organizations as well as their activity according to Article 9 of the Constitution
  • dismissal from duty of the President of the Republic and verification of the impossibility for him to exercise his functions
  • issues related with the election and incompatibility in exercising the functions of the President of the Republic and of the deputies, as well as the verification of election results
  • constitutionality of the referendum and verification of its results
  • final adjudication of the individual complaints for the violation of their constitutional rights, after all legal means for the protection of their rights have been exhausted
  • with the majority of all its members.
