Fitzhugh was born in King George County, Virginia. He was in private practice, with some brief interruptions, from 1790 to 1803, in Fairfax County, Virginia. He was a Delegate in the Virginia House of Delegates from 1790–1791, and in 1802. On November 21, 1803, Fitzhugh was nominated by President Thomas Jefferson to a seat on the United States Circuit Court of the District of Columbia vacated by James Markham Marshall. Fitzhugh was confirmed by the United States Senate on November 25, 1803, and received his commission the same day, serving thereafter until his death, in 1814, in Fairfax, Virginia. References
